Terms of Use
Obituate is made by Bainbridge Death Support, LLC, a Washington company owned by Miranda Sita on Bainbridge Island, Washington ("we" or "us"). By using Obituate you agree to these terms.
1. What Obituate is
Obituate helps a family write an obituary and check its facts together. Writing, checking and getting the text ready for a newspaper are free. There is no account to create.
Obituate does not write anything for you. It arranges the words you give it and runs checks on things like dates, ages, spelling and word count.
2. Your words are yours
You and your family own everything you write in Obituate. We don't receive your draft, and we never claim any rights to it.
3. You decide what's true
Obituate's checks are aids. They catch many mistakes, but not every one. You and your family are responsible for what your obituary says and for what you send to a newspaper, funeral home or anyone else. Please read the final version carefully before it goes out.
4. Where your draft lives
Your draft is saved in your own browser, on one device. If you clear your browser, lose the device or switch computers, we can't get it back for you, because we never had it. Save a draft file or buy the Keepsake Kit if you want a lasting copy.
5. The Keepsake Kit
The Keepsake Kit costs $149, paid once, for one family. It includes a sealed archive of your obituary, fact sheet and family roster that opens offline for as long as you keep the file, plus the typeset submission packet and keepsake. Stripe handles the payment, and Obituate never sends Stripe your draft. Anyone, anywhere, can buy the Kit, and the free tool is open to everyone. If you live outside the United States, the consumer rights your local law gives you still apply, and nothing in these terms takes them away.
6. Things Obituate doesn't do
Obituate isn't a funeral home, a newspaper or a legal service, and it doesn't give legal, medical or grief counseling advice. Newspapers set their own prices and rules, and Obituate's cost estimates are guides, not quotes.
7. Fair use
Please don't use Obituate to write something false or hurtful about a real person, to impersonate a family, or to break the law.
8. If something goes wrong
We work hard to keep Obituate working and accurate, but it's provided as it is, without guarantees. If you bought a Kit, the most we're responsible for is the $149 you paid.
9. Changes
If we change these terms, we'll post the new version here with a new date. Changes never take away a Kit you've already bought.
10. The law that applies
These terms follow Washington State law.

Refund Policy
If the Keepsake Kit isn't right for your family, email miranda@bainbridgedeathsupport.com within 30 days of buying it, and we'll refund the full $149. You don't need to give a reason.
Kit keys work offline, so we can't switch a Kit off after a refund. Your archive keeps working. We'd rather a grieving family keep it than lose something they made.
Refunds go back to the card you paid with, usually within 5 to 10 business days, depending on your bank.
